1. About These Terms

These Terms and Conditions govern your use of the Bush Billabongs website (bushbillabongs.com.au) and any purchase of products through this website. By accessing or using our website, you agree to be bound by these terms.

Bush Billabongs Pty Ltd (ABN 97 146 094 166) operates this website from Sydney, New South Wales, Australia.

2. Products and Services

Bush Billabongs supplies septic tanks and related wastewater products for sale to end users across Australia. We are a product supplier only.

We do NOT provide:

• Installation services of any kind
• Excavation or earthworks
• Plumbing connections or plumbing advice
• Council approval assistance or regulatory guidance
• Wastewater system design or consultancy

It is the customer's sole responsibility to ensure that any product purchased is suitable for their intended use, complies with applicable local council requirements, and is installed by a licensed professional where required by law.

3. Ordering and Payment

All prices displayed on the website are in Australian Dollars (AUD) and include GST unless otherwise stated. We reserve the right to change pricing at any time without notice. The price applicable to your order is the price displayed at the time of purchase.

Payment must be made in full at the time of ordering via the payment methods available on our website. An order is not confirmed until payment has been received and processed.

We reserve the right to cancel or refuse any order at our discretion, including where stock is unavailable, pricing errors have occurred, or we suspect fraudulent activity. If we cancel your order, you will receive a full refund.

4. Collection and Delivery

Bush Billabongs operates a self-service pickup model. When placing your order, you will select a pickup location from our available network of regional pickup yards.

Customer responsibilities at collection:

• You must bring a suitable vehicle and any required tie-down equipment
• You are responsible for safely loading and transporting the tank from the pickup point
• You must collect within the timeframe specified in your order confirmation
• Identification may be required at the point of collection

Bush Billabongs is not liable for any damage, injury, or loss that occurs during or after collection, including during transport from the pickup location to your property.

If you fail to collect your order within 30 days of the nominated collection date, we reserve the right to cancel the order and issue a refund less a restocking fee of $100 AUD.

5. Risk and Title

Title to the product passes to the customer upon receipt of full payment. Risk of damage or loss passes to the customer at the point of collection from the pickup yard. Once you or your agent have taken physical possession of the product, Bush Billabongs accepts no liability for damage, loss, or defects arising from transport, handling, storage, or installation.

6. Warranty

All products sold by Bush Billabongs come with a manufacturer's structural warranty. Details of the warranty period and terms will be provided with your order documentation.

This warranty covers defects in materials and manufacturing only. It does not cover damage caused by improper installation, misuse, modification, exposure to conditions outside the product's specifications, or failure to follow installation guidelines.

Nothing in these terms excludes, restricts, or modifies any consumer guarantee under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded by law.

7. Limitation of Liability

To the maximum extent permitted by law, Bush Billabongs' total liability to you for any claim arising from or related to the purchase of products is limited to the purchase price of the product.

Bush Billabongs is not liable for any indirect, consequential, or incidental loss or damage, including but not limited to loss of profits, loss of use, cost of installation or removal, or delay costs.

Bush Billabongs does not warrant that any product is suitable for a particular purpose, compliant with a particular council requirement, or appropriate for a specific site. It is the customer's responsibility to seek independent professional advice.

8. Privacy

Your personal information is collected, stored, and used in accordance with our Privacy Policy, available on our website. We comply with the Australian Privacy Principles under the Privacy Act 1988 (Cth).

9. Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of Bush Billabongs Pty Ltd or its licensors and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, or use any content without our prior written consent.
